O'Brien Ultimate Roadtrip Playlist Promotion

Conditions of Entry

1. Information on how to enter and prize details set out in all communications regarding the O'Brien Ultimate Roadtrip Playlist Promotion (“Promotion”) form part of the Conditions of Entry. By participating in the Promotion, each entrant fully and unconditionally agrees and acknowledges that these Conditions of Entry and the decisions of the Promoter on all matters relating to the Promotion are final and binding. Entrants must be individuals who are eligible to participate in the Promotion as set out in these Conditions of Entry (“Eligible Entrants”).

The Promotion

2. The “Promoter” is O'Brien Glass Industries Limited (ABN 74000022275), 45 Davies Road, Padstow NSW 2211, Australia.
3. The “Promotional Period” for this Promotion commences Thursday 10 June at 9 am (AEST) and concludes on Thursday 1 July at 5 pm (AEST).
4. The total prize pool value is $356. There are four (4) prizes consisting of a portable Bluetooth speaker (valued at $89)

How to Enter

5. Entry into the Promotion is open to a person who is a resident of Australia, over the age of 18 years, and submits their details via the
6. Each Eligible Entrant who nominates a song they would like included on the O'Brien® Ultimate Roadtrip Playlist will receive one (1) entry in the draw to win one of the four prizes.
7. There is no limit to the number of songs one person can nominate and each song received is an entry into the draw.
8. Any songs with lyrics deemed offensive or inappropriate as determined by the Promoter in its sole discretion, will be excluded and will not be eligible for any prize.

Prize Draw

9. The prizes will be drawn on Wednesday 16 June, Wednesday 23 June, Tuesday 29 June and Thursday 1 July 2021.
10. The prize winners will be notified by email by the Promoter using the contact details provided to the Promoter on the entry form and advised that their entry has been drawn, within 24 hours.
11. The prize winners’ names will be available in writing upon written request to O'Brien Glass Industries Limited, 45 Davies Road, Padstow NSW 2211, Australia. The details of the winners of the prizes drawn in this Promotion will be published on our Facebook and Twitter social networks within 24 hours.
12. Should a prize remain unclaimed by a winner, an unclaimed prize draw will take place on Thursday 17 June, Thursday 24 June, Wednesday 30 June or Friday 2 July 2021. The winner will be notified by email and will be published on our Facebook and Twitter social feeds within 24 hours.
13. The Promoter may amend or extend the time for contacting the winners, at its absolute discretion, by posting the extension on its Facebook site.
14. No prize is either redeemable for cash or transferable. Each prize winner will accept the prize ‘as is’ and acknowledges that the Promoter accepts no responsibility for any variation in the value of the prize. There will be no compensation in the event that the prize winner is unable to use all or part of the prize.
15. All valid claims for a prize and entitlements will be met unless in the Promotor’s reasonable opinion they involve fraud or ineligibility. The Promoter reserves the right, and by their entry into the Promotion, each Eligible Entrant consents to the Promoter exercising this right, to validate and check the authenticity of entries and prize claims.

General entry provisions

16. The Promoter has no responsibility for any tax implications that may arise from winning the prizes.
17. The Promoter does not assume any responsibility for any products offered as prizes under or purchased to participate in, the Promotion. The products are offered as is displayed on the entry form. The products and services have not been certified by the Promoter and under no circumstances shall the inclusion of any product in the Promotion be construed as an endorsement or recommendation of such product or service by the Promoter.
18. Except for warranties and conditions implied by law which cannot be excluded, the Promoter makes no representations or warranties, express or implied, regarding the quality or suitability of any prizes awarded under these Conditions of Entry.
19. The Promoter and its associated agencies and companies and their respective directors, officers, employees and agents, shall not be liable for any loss or damage, including for any personal injury suffered or sustained in connection with the entrant’s participation in the Promotion or the receipt or use of any part of any prize, except for any loss or damage which is due to the negligence or wilful misconduct of the Promoter or which otherwise cannot be excluded by law.
20. The Promoter, their agencies and companies associated with this Promotion will not be responsible for the following: (1) technical failures of any kind including but not limited to any error, omission, interruption, deletion, defect, delay in operation or transmission, communications, line failure or the malfunctioning failure or unavailability of any computer, server, cable, line, network, hardware, software, internet service or web site; (2) unauthorised human intervention in any part of the entry process of the Promotion, including but not limited to theft, destruction or unauthorised access to, or alteration of the Promotion; (3) electronic or human error which may occur in the administration of the Promotion or the processing of entries; or (4) any entry that is late, lost, stolen, damaged or misdirected or otherwise not received.
21. The Promoter, in its sole discretion, reserves the right to cancel, suspend, terminate or modify the Promotion if fraud, technical failures or any other factor beyond the Promoter’s reasonable control adversely affects the Promoter’s ability to conduct the Promotion as contemplated in these Conditions of Entry, subject to state regulation. In such an event, the Promoter reserves the right to award the Prize at random from among the eligible entries received up to the time of the cancellation or modification. The Promoter also reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in breach of these Conditions of Entry or breach of any law or to be acting in an unsportsmanlike, non-genuine or disruptive manner.
22. The Promoter will use its best endeavours to provide the prizes listed. If any of the prizes are unavailable for whatever reason, the Promoter reserves the right to substitute that prize or item for a prize or item of an equivalent value.
23. Records of all entries become and remain the sole property of the Promoter. Except where prohibited by law, participation in the Promotion constitutes the entrant’s consent to the storage, use and disclosure of the entrant’s entry details as set out in these Conditions of Entry.
24. Any cancellation or modification to the Promotion will be notified via Facebook
25. If all or any part of any term or condition contained in these Conditions of Entry is declared or becomes unenforceable, invalid or illegal for any reason, that term or provision (or part of that term or provision) will be deemed severed from these Conditions of Entry to the extent of the unenforceability, invalidity or illegality and the other terms and conditions will remain in full force and effect as if the offending term or provision (or part of that term or provision) had not been included in these Conditions of Entry.
26. These Conditions of Entry will be governed by the laws of the relevant state or territory of Australia and each entrant agrees to submit to the nonexclusive jurisdiction of the courts of the relevant state or territory of Australia.

Collection and use of personal information

27. The Promoter may use any personal information of Eligible Entrants provided in connection with this Promotion for the purpose of running the Promotion, and also in advertisements, publications, websites, media statements and other promotional material associated with the Promotion. The Promoter may disclose the information for those purposes to its related bodies corporate and contractors.
28. By participating in the Promotion, each entrant acknowledges and agrees that a further primary purpose for the collection of personal information by the Promoter is to enable the Promoter to contact the entrant in the future in relation to this Promotion. Entry is conditional on providing this information which will be handled in accordance with the Privacy Policy available at http://www.obrienautoglass.com.au/privacy-policy/.
